Licence Terms (EULA)

This End-User Licence Agreement ("Terms", "EULA") governs the use of the software products of the Precious Metals Suite between you ("User") and Sammeltresor UG (haftungsbeschränkt). By installing, activating or using any product of the Precious Metals Suite, you agree to these Terms. If you do not agree, you may not use the software.
1. Contracting Party and Scope
The provider is Sammeltresor UG (haftungsbeschränkt), Alatseestr. 28, 87629 Füssen, Deutschland, registered in the Commercial Register of the Amtsgericht Kempten (Allgäu) under HRB 13043, represented by its Managing Director Markus Markert (hereinafter "Provider" or "we"). Contact: info@preciousmetalssuite.com.
These Terms apply to all editions of the Precious Metals Suite, in particular the Desktop App (Windows, macOS, Linux), the Mobile App (Android, iOS), the Browser Extension, the Office Add-ins (Microsoft Office as both a desktop and web application, as well as LibreOffice), each including the associated online services and the data provided.
2. Subject Matter and Services
The Precious Metals Suite provides precious metal prices (gold, silver, platinum, palladium, copper) in multiple currencies as spot prices and LBMA fixes, supplemented by charts, exchange rates, ratios, the Fear & Greed Index, calculators (including precious metal, buy-back, tax and savings plan calculators) and price alerts. The specific feature set depends on the respective edition and the chosen plan. We continuously develop our products; individual features may be added, modified or removed.
3. Account and Licence Key
Use of the software requires a user account, which is managed in the account area. One account is valid across all editions and platforms. You are obliged to keep your login credentials and licence keys confidential and to protect them against access by third parties. If you suspect misuse, you are obliged to notify us immediately.
4. Plans, Editions and Number of Devices
The software is offered under a permanently free "Free" plan as well as the paid "Standard" and "Plus" plans. The applicable features, prices and the number of devices that may be used per integration (operating system or application, e.g. Microsoft Office) are set out in the plan overview on our website or in the account, as applicable at the time the contract is concluded. Simultaneous use on more devices than permitted under the chosen plan is not allowed.
5. Contract Conclusion, Term and Termination
The contract for a paid plan is concluded upon completion of the order process and our confirmation or activation. Paid plans are offered as subscriptions with a monthly or annual term and renew automatically for the chosen term unless cancelled in good time. We will notify you in good time by e-mail before each automatic renewal. Consumers may cancel a subscription contract after any initial minimum term at any time by giving one month's notice. Cancellation may be effected via the account or in text form to info@preciousmetalssuite.com. The right to extraordinary termination for good cause remains unaffected.
6. Prices and Payment
The prices displayed at the time of the order apply. For consumers, prices are total prices inclusive of statutory VAT. Payment is made via the payment methods offered during the order process; annual subscriptions are paid in advance. For annual billing, we grant the price advantage shown in the plan for the Standard and Plus plans (two months per year). If the User falls into arrears with payment, we may suspend the paid features until the outstanding amount is settled.
7. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal of fourteen days for paid contracts. The withdrawal period begins on the day the contract is concluded. To exercise the right of withdrawal, a clear statement in text form (e.g. by e-mail) to the address given above is sufficient.
Early lapse: In the case of the provision of digital content and services, the right of withdrawal lapses if you have expressly consented to us beginning performance before the expiry of the withdrawal period and have confirmed your awareness that you thereby lose your right of withdrawal. We obtain this consent expressly during the order process.
8. Usage Rights (Licence)
With a valid licence you receive a simple (non-exclusive), non-transferable right, limited in time to the duration of the contract, to use the software as intended within the scope of the chosen plan and the permitted number of devices. The software is licensed, not sold; all rights not expressly granted remain with the Provider or the respective rights holders.
9. Usage Restrictions
Without our prior written consent, it is prohibited in particular to:
- pass on, rent, lend or sublicense the software or licence keys to third parties;
- reverse-engineer, decompile or disassemble the software, except to the extent expressly permitted by mandatory law;
- circumvent or remove technical protection or licence verification mechanisms;
- systematically scrape the provided data on a large scale or redistribute it as a data or API product of your own;
- use the software for unlawful purposes or remove copyright and trade mark notices.
10. Availability, Updates and Data Sources
We endeavour to ensure high availability of the online services but do not guarantee uninterrupted accessibility. Maintenance work, disruptions outside our control and dependencies on third-party providers (e.g. app stores, browser vendors, market data sources) may temporarily restrict use. We provide updates necessary to maintain conformity of the digital software during the term of the contract.
Precious metal prices and key figures are collected with due care from our own and third-party sources and updated promptly; however, we cannot guarantee accuracy, completeness or up-to-the-minute timeliness at all times. For actual transactions, the terms and conditions of the respective trading partner shall always prevail.
11. No Investment, Tax or Legal Advice
The prices, charts, indices and calculators provided are for information purposes only. They do not constitute investment, tax or legal advice and do not constitute an invitation to buy or sell precious metals or financial instruments. Results from the calculators (e.g. material, buy-back or tax values) are non-binding estimates. Investment and tax decisions are made at your own responsibility; where necessary, seek qualified professional advice.
12. Warranty
The statutory provisions on the provision of digital products apply. The Free plan is provided free of charge; our liability in this regard is limited to that prescribed by law for gratuitous services. Defects in paid products may be reported to us in text form; we will endeavour to remedy them promptly.
13. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee assumed. For a slightly negligent breach of material contractual obligations (cardinal obligations) whose fulfilment is essential to the proper performance of the contract and upon whose observance you may regularly rely, our liability is limited to the typically foreseeable damage. Beyond this, liability for slight negligence is excluded. Liability for lost investment returns or financial losses resulting from investment decisions made on the basis of the information provided is excluded to the extent permitted by law.
14. Third-Party Rights and Open-Source Software
The products include open-source components that are used under their respective licences. An overview of the components and licences used can be found on the Open-Source Licences page. In addition, licensed third-party components are used (e.g. the commercially licensed UI library Flux Pro and system runtimes of platform vendors). Third-party trade marks and product names are the property of their respective owners.
15. Privacy
How we handle personal data is described in our Privacy Policy. The products of the Precious Metals Suite operate without tracking, without advertising cookies and without external analytics tools.
16. Amendments to These Terms
We may amend these Terms with effect for the future to the extent necessary to adapt to changes in the legal framework, case law or the feature set, provided you are not thereby unreasonably disadvantaged. We will notify you of material changes in an appropriate manner (e.g. by e-mail or via the account) with reasonable notice before they take effect. If you do not object in good time or continue to use the products, the amended Terms shall be deemed accepted; we will specifically draw your attention to the significance of your conduct.
17. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In relation to consumers, this choice of law applies only insofar as it does not restrict mandatory consumer protection provisions of the country of their habitual residence. If the User is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered place of business.
We are neither obliged nor, as a rule, willing to participate in dispute resolution proceedings before a consumer arbitration body.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory rule.
